Terms of service

1. About us

katebarton.co.uk is run by Kate Barton Design Limited, trading as Kate Barton. Registered address: Boyce’s Building, Regent Street, Clifton, Bristol BS8 4HU. [Company number 12492737.]

Contact us at hello@katebarton.co.uk or by post at Church Farm, Prior’s Dean, Petersfield, Hampshire GU32 1BS.

2. These terms

These terms apply when you buy from katebarton.co.uk. Please read them, and our Refund policy, before you order.

We may update these terms from time to time. The version in place when you order is the one that applies to that order.

3. Your order

You must be 18 or over to place an order.

Please check your delivery address and contact details are correct before you order.

When you place an order, we’ll email you to confirm we’ve received it. Our contract with you starts when we email to confirm your order has been despatched.

If we can’t accept your order, for example because an item is out of stock or the price was shown in error, we’ll tell you and refund anything you’ve paid.

We may cancel an order if we suspect fraud or can’t verify your payment. We’ll refund anything you’ve paid.

We may limit how many of an item you can buy, for example during a sale.

Our products are for personal use. We may decline orders that appear to be for resale.

4. Pre-orders

Some items are available to pre-order. We take payment when you order. The expected despatch date is shown on the product page.

If the despatch date changes, we’ll email you. You can cancel a pre-order for a full refund at any time before it’s despatched.

5. Prices and payment

Our prices can change, but you pay the price shown when you placed your order.

Prices for UK orders include VAT.

Prices for the USA and Canada include import duty and taxes.

For EU orders over €150, import duty is calculated and charged at checkout. We ship Delivered Duty Paid, so there’s nothing more to pay on delivery. Orders under €150 have no import duty.

Delivery costs are shown at checkout before you pay.

If we discover a pricing error after you’ve ordered, we’ll contact you. You can then confirm the order at the correct price or cancel it for a full refund.

6. Gift cards and discount codes

Gift cards are valid for 12 months from the date they’re issued and can’t be exchanged for cash.

Discount codes can’t be used on gift cards, and may have an end date or other conditions shown with the offer.

7. Delivery

Delivery options, costs and times are on our Delivery & Returns page. Delivery times are estimates.

Items are your responsibility once they’ve been delivered to the address you gave us.

If your order hasn’t arrived within a reasonable time, email us and we’ll look into it. If it has been lost in transit, we’ll send a replacement or a refund.

8. Returns and your right to cancel

If you’re a consumer in the UK or EU, you can cancel your order within 14 days, starting the day after delivery, without giving a reason.

You pay the direct cost of returning the goods. For UK customers using our Royal Mail QR code or label, this is £3, deducted from your refund.

We also offer gift cards within 30 days of delivery, and exchanges within 30 days for UK orders.

To start a return, visit our returns portal.

Full details, including how to cancel and a model cancellation form, are in our Refund policy.

9. Faulty items and your legal rights

We’re legally required to provide goods that are as described, fit for purpose and of satisfactory quality.

If an item is faulty or not as described, you may be entitled to a full refund within 30 days of delivery. After that, you may be entitled to a repair or replacement, or in some cases a refund.

To make a claim, start a return in our returns portal [link: /apps/returns] and choose “It’s faulty or damaged”, or email hello@katebarton.co.uk. If you’ve received the wrong item, please email us.

Nothing in these terms affects your legal rights. For more information, contact Citizens Advice (citizensadvice.org.uk).

10. Product information

We photograph our pieces as accurately as we can, but colours can look different on different screens.

Please use our Size Guide  and the measurements on each product page to choose your size.

Please follow the care label. Damage from washing or care that goes against the label isn’t a fault.

11. Our responsibility to you

If we break these terms, we’re responsible for loss or damage you suffer that is a foreseeable result. We’re not responsible for loss or damage that isn’t foreseeable.

We don’t exclude or limit our liability where it would be unlawful to do so. That includes death or personal injury caused by our negligence, fraud, and your legal rights as a consumer.

We sell to consumers for personal use. We’re not liable for any business losses, such as lost profit or lost business opportunity.

12. Events outside our control

If something outside our control delays or prevents delivery, such as a strike, severe weather or a carrier failure, we’ll tell you as soon as we can. If the delay is significant, you can cancel and get a full refund for anything not yet delivered.

13. Using our website

You may use our website for personal shopping only. Please don’t misuse it, for example by introducing viruses, attempting to gain unauthorised access, or copying content in bulk.

All content on this website, including designs, photographs and text, belongs to Kate Barton or its licensors. Please don’t copy or reuse it without our written permission.

We may link to other websites. We’re not responsible for their content.

If you send us comments, reviews or photos, you allow us to use them in connection with our business. Please make sure you have the right to share them. We may remove reviews or comments that are offensive, unlawful or misleading.

14. Your information

We use your personal information as set out in our Privacy notice.

15. Complaints

If you’re unhappy with anything, please email hello@katebarton.co.uk. We aim to reply within 5 working days and will do our best to put things right.

16. Other terms

If a court decides part of these terms is unlawful, the rest will still apply.

If we don’t enforce a right straight away, we can still enforce it later.

Only you and we have rights under these terms.

17. Which laws apply

These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you live in the EU, you keep any protection given to you by the law of the country you live in.
